Transgender Policies and Social Implications in Indonesia: A Legal, Pancasila and Islamic Perspectives

Abstract

The transgender phenomenon in Indonesia presents a multidimensional challenge involving legal, social, and religious aspects. As a nation founded on Pancasila and the 1945 Constitution, Indonesia recognizes fundamental human rights, yet religious norms, particularly Islamic teachings, largely reject gender reassignment. This study analyzes transgender regulations and social implications from legal, Pancasila, and Islamic perspectives using qualitative content analysis. Data were collected from books and scholarly articles published in national and international journals, and analyzed through Miles and Huberman’s interactive thematic technique. Findings reveal that Indonesian law does not explicitly regulate transgender identity, although gender reassignment is possible through court rulings. From the perspective of Pancasila, tension arises between the first principle, Belief in One God, which emphasizes religious values, and the second principle, Just and Civilized Humanity, which demands respect for human dignity. Islamic perspectives, reinforced by the Indonesian Ulema Council fatwa, reject gender reassignment except in specific medical conditions. These differing viewpoints highlight the need for a balanced and inclusive policy approach that integrates legal, social, and religious considerations to prevent societal division and promote harmony.
